N HELD OFFICE <br />D OF <br />RECLAMATION MIINNING & SAFETY <br /> <br />Re: Substitute for NoticeITnemporary Cessation <br />File No. M-2007-044, Whirjwind Mine,Xesa County, Colorado <br />Dear Russ: <br />MAY 2 6 2009 <br />Division of F;ec:ama4'00' <br />Nlirl ng and Safety <br />Energy Fuels Resources Corporation (Energy Fuels) put the Whirlwind Mine on stand-by <br />status on November 20, 2008 and is providing this Substitution for Notice of Temporary <br />Cessation to the Division of Reclamation, Mining, and Safety (DRMS) per Section 1. 13.7 <br />of the Colorado Hard Rock/Metal Mining Rules and Regulations. Energy Fuels <br />understands that this notice will put the Whirlwind Mine into a classification of <br />"intermittent" status. This notice is a technical revision to the mine permit application <br />and a check for $1,006 is attached to cover the technical revision fee. <br />This change in status occurred due to current economic conditions and the current <br />depressed spot market price for uranium. As of May 19, the mine will have been on <br />stand-by status for 180 days. Up to this point, Energy Fuels could not state for certain <br />that the length of this change in status would endure for more than 180 days, since the <br />change in status is linked to the market price of uranium, which is out of our control. <br />Intermittent status will allow Energy Fuels to continue to maintain the mine in its current <br />condition so that production may resume on short notice when market conditions <br />improve. While the mine is in intermittent status, Energy Fuels plans to operate the mine <br />for less than 180 days per year. Mine personnel have been and will continue to be on site <br />periodically to conduct mine safety inspections, environmental monitoring, mine <br />dewatering, water treatment and maintenance. Property gates, buildings, and portal doors <br />will be locked to discourage unauthorized access when mine personnel are not present. <br />Most of the mine equipment has been temporarily removed from the site for storage. Our <br />current plans are to continue to pump mine water to the surface where it will be treated <br />and discharged on an intermittent basis. The mine will be ventilated only when personnel <br />need to go underground. <br />Environmental inspections and monitoring required by our 112d Permit and other permits <br />will continue during the intermittent status period. This includes sampling and analyses <br />of the recently installed groundwater monitoring well.
