For the South Taylor reclamation unit, the Division would accept a variable
replacement plan incorporating narrative and mapping commitments adequate to
ensure replacement of a significant acreage of at least three soil replacement
zones, as follows:
• a "thin soil" zone, with a 0 to 8 inch replacement range and a 4 inch
minimum average thickness;
a "medium thickness" zone, with a 14 to 20 inch replacement range and a
16 inch minimum average thickness, and;
• a "thick soil" zone, with a 30 inch to 48 inch replacement range, and a 36
inch minimum average thickness.
Due to the length of time associated with review of TR-72, the resulting delay in
reclamation that has resulted, and the lack of progress that has been made toward
an approvable variable topsoil replacement plan, the Division will impose the
following stipulation on the TR-72 proposed decision.
STIPULATION 13
WITHIN 60 DAYS OF TR-72 FINAL APPROVAL, THE PERMITTEE
WILL SUBMIT A COMPLETE TECHNICAL REVISION APPLICATION
PROVIDING A DETAILED PLAN FOR VARIABLE THICKNESS
TOPSOIL REPLACEMENT, TO INCLUDE NARRATIVE AND
MAPPING THAT DELINEATES TOPSOIL REPLACEMENT ZONES OF
SPECIFIED THICKNESS RANGE AND MINIMUM AVERAGE
THICKNESS. THE PLAN WILL CONTAIN DETAILS AND
COMMITMENTS ADEQUATE TO DEMONSTRATE COMPLIANCE
WITH RULE 4.06.4(2)(A) AND BE ADEQUATE TO ENSURE THAT
ECOLOGICALLY SIGNIFICANT VARIATION IN SOIL THICKNESS
WILL BE ACHIEVED (INCLUDING COMMITMENT TO
APPROPRIATE ANNUAL MONITORING AND REPORTING).
THE MAPPING AND NARRATIVE WILL CLARIFY THE
APPROXIMATE EXTENT AND GENERAL LOCATION OF
ENHANCEMENT PROCEDURES MENTIONED IN THE TR-72
NARRATIVE, INCLUDING SOIL BERMS, EXTENSIVE SOIL
ROUGHENING, AND SNOW FENCE INSTALLATION.
RECLAMATION OPERATIONS INCLUDING TOPSOILING AND
REVEGETATION WILL PROCEED IN 2009, WHETHER OR NOT A
VARIABLE TOPSOIL REPLACEMENT PLAN IS APPROVED. UNLESS
AND UNTIL A VARIABLE THICKNESS TOPSOIL REPLACEMENT
PLAN IS APPROVED BY THE DIVISION, TOPSOIL REPLACEMENT
WILL ACHIEVE AN APPROXIMATE UNIFORM THICKNESS OF 8
INCHES THROUGHOUT THE POST-2008 PORTIONS OF THE
