III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a Partial inspection conducted by Janet Binns of CDRMS. This was a bond release inspection for Bond Release <br /> application SL4. SL4 was determined to be complete on May 8,2009. SL4 requests phase Ill bond release on reclaimed <br /> parcels that have previously been approved for phase I and II bond release. Don MacDonald and Danny Kipp of Coors <br /> Energy Company accompanied the inspection. Mike Savage of Savage and Savage Environmental Associates accompanied <br /> the inspection as a representative of the operator. The mine no longer extracts coal, but the remaining surface pit (Pit B) is <br /> permitted to dispose of flyash. CEC caps, regrades, topsoils,mulches and seeds the pit as the ash fill progresses. The <br /> weather was clear, warm, and windy at the time of the inspection. <br /> Roads: The haul road to the pit and return to the facilities were dry and well graded. Road side ditches-had been recently <br /> shaped No ash was being hauled during the inspection nor was any spoil being worked at the time. The haul road is in <br /> good condition. A water truck was watering the haul road on the east side of Pit B during the inspection. <br /> Hydrologic Balance: The mine site was dry but had received adequate precipitation in recent storms. The dugout pond was <br /> dry, but Pond 2 held a small pool of water. The puddle of water at the North end of Pit B was still present. <br /> Support facilities: The location of a proposed third party gas well immediately to the west of theāž¢ pit was identified. The <br /> gas company has located the drill site close to the edge of the B pit highwall. The proposed fence line is 30 feet from the <br /> western edge of the pit. CEC considers this distance adequate to continue their operation without interference. The gas <br /> drilling and maintenance operation will access the site from an existing road located west of the pemut area. The lower lift <br /> of ash has already been placed in the bottom of B pit adjacent to this proposed well location. The well location visibly <br /> appears far enough away from the highwall to not cause instability of the highwall. <br /> Reclamation Success: <br /> Area l:The inspection of the reclaimed parcels began at Area 1 at the north east area of the mine operation. Area 1 was <br /> seeded in 1995. It is a relatively flat parcel consisting of 7.54 acres. The vegetative cover was good to fair,with some areas <br /> of the vegetation more lush than others. Overall, this parcel is in good condition with no weedy patches or erosional <br /> features. <br /> Area 27: Area 27 was also seeded in 1995. This parcel is relatively flat,drains to the north and consists of 3.15 acres. <br /> Vegetation is healthy and diverse. Dominant visual species at this time in the growing season are Smooth bromegrass, <br /> Wheatgrasses and Little bluestem.
