MOUNTAIN COAL
?COMPANYL.L.C.
A Subsidiary of Arch Western Resources, LLC
West Elk Mine
P.O. Box 591
5174 Highway 133
Somerset, CO 81434
(970) 929-5015
Fax(970)929-5595
* A topographical map of the project area will be forwarded to the SHPO to provide
confirmation that no cultural resources are known to exit within the project area. These
findings will be forwarded to the CDRMS.
9. If the proposed drilling area is not within an area currently reporting to a sedimentation pond, a
description of how the drilling area will qualify as a small area exemption per 4.05.2(3);
* As this area will not drain to the RPE sediment ponds, alternate sediment control measures
will be utilized, including best management practices straw bales, silt fence and/or excelsior
waddles.
10. A description of whether the so-called "Tweety" drainage proposed for fording is an ephemeral
stream with an upstream watershed of a least one square mile (4.03.3(2)(c));
* The majority of the Tweety Gulch drainage is located within the west half of Section 15 and
is within an area of less than one square mile in size (approximately 0.7 square miles.) Also, as
it is an ephemeral drainage, no flows typically exist requiring fording.
11. A description of how surface water runoff from the proposed new light use road during its
construction, use, maintenance and reclamation will prevent causing additional contributions of
suspended solids to streamflow or to runoff outside the permit area (4.03.3(1)(b);
4.03.3 (4)(a)(ii)).
* As in response #9 above, alternate sediment control measures will be utilized, including best
management practices such as straw bales, silt fence and/or excelsior waddles.
Please contact me at (970)929-2238 or by e-mail should you have further questions regarding this submittal.
Sincerely,
Kathleen G.
