III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Pond 11 discharge was also somewhat discolored and a sample was obtained and split with the operator. <br /> Settleable Solids was analyzed by Grand Junction Laboratories on 4/24/09, and the reported value was 0.1 ml/I, <br /> which is below the CDPS permit standard of 0.5 ml/I. As with Pond 12, there was heavy flow of sediment laden <br /> snowmelt runoff into the pond at the time the sample was taken. Inflow was discharging over the top of the <br /> spillway riser. <br /> Ponds 13 and 14 were both discharging over the top of their spillway risers due to snowmelt inflow, but in both <br /> cases the discharge was relatively clear. <br /> Backfilling and Grading; Slides & Damage <br /> Due to remnant snow cover in some areas and limited accessibility due to snow and mud, detailed observations <br /> were precluded in most areas. The large Pond 12 slope failure that occurred last spring has not yet been <br /> remediated, due to on-going monitoring being conducted to allow for development of an effective remediation <br /> plan. The main body of the slide appears much as it did last spring. However, there appears to have been <br /> additional movement along the west end of the slide immediately north of Pond 12. Where there were only <br /> cracks last year, there is now a settling scarp several feet high,just upslope from a temporary road north of <br /> Pond 12 that was constructed to allow access for monitoring and remediation. A report and remediation plan for <br /> the slide is to be submitted later this year. <br /> Given the relatively large acreage of recent steep slope reclamation, it is anticipated that a considerable amount <br /> of rill and gully repair work will be warranted this field season (both permanent channel and hillslope areas). In- <br /> slopes of new Pond 12A were heavily rilled in a few locations, and minor settling cracks were evident on the <br /> steep slope west of Pond 12A. The operator is responsible for conducting site inspection and identifying rill and <br /> gully and slide features that require repair in the annual Rill and Gully Inspection Map, as soon as practicable <br /> following the end of snowmelt runoff. The Division will assess these topics more thoroughly in a subsequent <br /> inspection, when site conditions allow for better access and visibility. <br /> Topsoil & Revegetation <br /> Due to snow cover, limited access, and season, these topics could not be closely evaluated at this time. <br /> 5 <br />
