Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: File No. M-2004-009; Turnpike Mining Resource; Technical Revision 03 - <br />Revise Mine Plan and Reclamation Plan configuration, Submitted by Asphalt <br />Specialties Co., Inc. - Second Adequacy Review <br />Dear Mr. Laird: <br />The Division of Reclamation, Mining and Safety (DRMS) has completed its preliminary <br />adequacy review of the Technical Revision (TR03). The revision was received on March <br />2, 2009 and called complete for review on that date. The decision date for this revision is <br />currently May 18, 2009. Please be advised that if you are unable to satisfactorily address <br />any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this revision. In general the <br />submission was substantially adequate; however, as with most revisions there are a few <br />items that will require the submittal of additional information or clarification of the <br />existing information. The only remaining comments pertain to the configuration of the <br />clay liner keyway design, and the submitted reclamation cost estimate. <br />• The ECC letter included with the TR03 Adequacy Comments states: <br />"The installation of the core trench will be dependent on field conditions as determined <br />during construction. The purpose of the deepened core trench is to minimize seepage out <br />of the reservoir as well as to minimize groundwater inflow into the reservoir. Provided a <br />slope stability analysis and a seepage analysis indicates a shallower core trench is <br />feasible and performs as design intended, ECC is not opposed to the minimum 3 foot <br />depth keyway as suggested by Deere and Ault" <br />Have any slope stability analyses or seepage analysis been conducted at this time to <br />demonstrate that the proposed 3foot keyway would meet design standards? What criteria <br />would need to be satisfied for these tests to show that the 3 foot keyway would be <br />adequate?
