Montoya Gravel Expansion EA <br />3. If subsurface cultural resources are unearthed during operations, activity in the vicinity of <br />the cultural resource will cease and a BLM representative will be notified immediately. <br />Pursuant to 43 CFR 10.4 the holder of this authorization must notify the authorized <br />officer immediately (by telephone and written confirmation) upon the unlikely discovery <br />of human remains, funerary items, sacred objects, or objects of cultural patrimony. <br />Further, the operator must stop activities in the vicinity of the discovery and protect it for <br />30 days or until notified to proceed by the authorized officer. <br />4. The operator is responsible for informing all persons associated with this project that they <br />will be subject to prosecution for knowingly disturbing Native American Indian shrines, <br />historic and prehistoric archaeology sites, or for collecting artifacts of any kind, including <br />historic items and/or arrowheads and pottery fragments from federal lands. <br />5. The operator will contribute ten cents/ton to the Grandview Ridge mitigation fund. These <br />funds will be 'used to manage resources in the Grandview Ridge parcel. If cultural <br />resources are found, and mitigation costs exceed the amount in the mitigation fund, the <br />operator is responsible for all additional costs, including payment for all of BLM's costs <br />for monitoring of the mitigation work. <br />6. The Operator is responsible for reclamation of all surface disturbances on public lands <br />that are related to activities conducted under previous contracts issued to C and J Gravel. <br />Interim and final reclamation must be initiated at the earliest economically and <br />technically feasible time. Interim reclamation will be initiated when an area will not be <br />used for a minimum of three years. Interim reclamation will consist of maintaining <br />surfaces in a stable condition which will not erode. Surfaces will be vegetated with a <br />seed mix that is approved by the BLM. Final reclamation will be implemented when an <br />area will clearly not be used for operations in the future. Final reclamation will consist of <br />recontouring disturbed surfaces to natural contours and re-vegetating with a BLM- <br />approved native seed mixture. The operator would repeat seeding as needed to meet <br />BLM vegetation standards. Revegetation would be considered to be complete when a <br />permanent, reproducing plant community has been established that meets long-term use <br />goals. <br />7. Disturbed areas will be monitored annually for invasive, non-native species. <br />8. All vehicles and heavy machinery will be cleaned to remove seed and soil prior to and <br />after clearing vegetated surface areas. <br />9. The operator will spray for noxious weeds twice annually. Because musk thistle is listed <br />as a priority and enforceable weed by La Plata County, all musk thistle populations less <br />than one acre in size will be designated for eradication. Larger populations (>I acre) will <br />be designated for incremental management. All noxious and invasive species which <br />occur on site will be eradicated using materials and methods approved in advance by the <br />BLM. <br />10. Vegetation-clearing activities will not occur from May 15 through July 15, annually, to <br />is avoid direct impacts to nesting piiion jays. If vegetation clearing cannot avoid this 60- <br />day period, surveys for pinon jay nesting activity will be conducted by a qualified <br />6
