COUNTY ZONING: Statement from La Plata County Community Development and <br />Planning Office (original submitted directly to MLRB): <br />TO: Colorado Mined Land Reclamation Board <br />SUBJECT: Montoya Pit, M-1980-146, Location: Sections x, 4, 10, T 34.ON R9.OW, 100, <br />(N.M.) PM. <br />Pursuant to Section 34-32-115(4)(e), C.R.S., if a permit is granted, the proposed mining <br />operation would not be in violation with city and county zoning or subdivision regulations <br />or contrary to a master plan for extraction adopted pursuant to Section 34-1-304, C.R.S., as <br />amended. <br />Pursuant to Section 34-32-108(8), C.R.S., the operator's (C&J Gravel Products, Inc.) <br />reclamation plan is consistent with all adopted plans by La Plata County and the City of <br />Durango. <br />2. WILDLIFE: There is currently no water source on the Grandview ridge mesa. Under the <br />direction of BLM, C 8 J Gravel wilt build or use existing ponds and supply water via water truck <br />to the ponds during the dry season or as needed. <br />3. WEED CONTROL: All growth medium and overburden stockpiles will be seeded with <br />approved BLM seed mix to help control dust. These same stockpiles will also be subject to C & J <br />gravel's weed control plan as approved by La Plata County. C&J's goal is to eradicate all <br />noxious weeds from the mine. <br />4. FUGITIVE DUST CONTROL PLAN: All necessary control measures will be used as <br />outlined on page 5 of Construction Permit 99LP0697F as issued by Colorado Department of <br />Public Health and Environment, Air Pollution Control Division. <br />5. NOISE CONTROL: Noise control is regulated by the Mine Safety and Health <br />Administration (MSHA) for miners only. All test results are kept on file and will be made <br />available to BLM as needed. State regulations limit noise to 55 dBA at the property edge. <br />6. HAZARDOUS MATERIAL: Any hazardous materials such as fuel and oils are located <br />within containment berms as required by DRMS, DOLE, and MSHA. All hazardous materials <br />will be stored offsite of BLM permit areas. Any accidental spills of hazardous material onto <br />BLM land will be reported within one working day and clean up will be under the direction of <br />the BLM; otherwise applicable state/federal law will be followed for reporting and response. <br />Note: "Hazardous Material " as defined by BLM does NOT necessarily meet the definition as <br />established by other agencies, including the DRMS. <br />7. OPERATIONS SAFETY PLAN: C&J Gravel operates under the regulation of and in <br />complete accordance with MSHA regulations: MSHA 30 CFR, Part 48, Subpart B-E and Part 56. <br />8. STORM WATER MANAGEMENT PLAN: This plan is on file with CDPHE Water <br />Quality Control Division and is reviewed and updated annually. Any maintenance or corrective <br />action is done as needed and reported annually. A small portion of a sediment pond is located on <br />the BLM permit. This pond is a result of gravel mining and was encouraged by the Division of <br />Minerals and Geology (DMRS) to be incorporated into the storm water management plan.
