New Horizon Mine TR-58 <br />P Adequacy Review <br />30 April 2009 <br />Page 2 of 4 <br />The success standard for WFC's irrigated pasture will involve <br />statistically adequate sample based comparison to an approved <br />reference area. The sampling "will be conducted a single time <br />during late May-early June (immediately prior to I sr cut harvest of <br />the reclaimed fields; with reference and reclaimed areas to be <br />sampled within a 7 day timeframe). <br />Please consider this concern and the suggested alternative language, and revise <br />the 2nd paragraph of amended page (e)-19, as appropriate. <br />The narrative was amended as requested. Item Resolved. <br />3. Amended page (e)-19C contains the following statement in the first full paragraph <br />on the page: <br />For the reasons listed above, it is proposed that the fixed standards <br />for cover and production for all irrigated pasture in the permit <br />area be abandoned in favor of an irrigated pasture reference area. <br />For clarification, and to eliminate the possibility of differing interpretations that <br />could lead to misunderstanding and concern on the part of interested parties, we <br />would suggest the following wording: <br />For the reasons listed above, it is proposed that the fixed standards <br />for cover and production for all areas reclaimed to irrigated <br />pasture be abandoned in favor of an irrigated pasture reference <br />area. Prior to submittal of Phase II or Phase III bond release, the <br />permit will be revised to specify that areas reclaimed to irrigated <br />agricultural use west of 2700 Road and south of BB Road will be <br />classified as Irrigated Cropland postmining land use, and as such <br />will be subject to Irrigated Cropland success standards. The <br />proposed Irrigated Pasture Reference area is applicable only to <br />Irrigated Pastureland postmining land use areas, not to Irrigated <br />Cropland postmining land use areas. <br />The narrative was amended as requested. Item Resolved <br />4. One minor clarification is requested with respect to proposed reference area <br />livestock grazing. Please insert a sentence into the ` plans for livestock grazing" <br />paragraph on page 19D, stating that "livestock will be moved off the reference <br />area by the end of June, and the reference area will not be further grazed by <br />livestock during the growing season ". <br />The narrative was amended as requested.
