III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
Refuse Pile: Waste material placement continues on the southern areas of the pile. Benching on the east
side of the pile needs to be implements as required in the construction plan. Material placement
continues on the west side of the pile. TCC appears to be tying the fresh material into the slope of the
older material as previously discussed. Drainage around the pile appears functional except the northern
100-year ditch. Shaping of the ditch is needed to assure runoff stays in the appropnate ditch.
Ditch to from the Clay storage area has been cut to assure flow, but road way still needs some dress up
once this area south of the Refuse pile dries up.
Support Facilities: Drainage on the South side of Wash Plant II needs to be shaped, and ditches re-
established. Propane tanks east of Wash Plant B need to be shown on facilities map. The Ditch south of
the portal area needs to be updated in the permit but is flowing well and is being maintained well to the
sump. Emergency overflow sump south of the Wash plants needs along term solution, snowmeh has
added to the water level, but this should begin to dry up.
Wildlife: Elk were observed near the tum off for the Fish Creek Bore hole road. Red Tail hawk and
Owl are nesting along RCR 33 alongside Foidel Creek east of the main facilities (overlying the EMD).
Care need to be taken not disturb the nests, since mining in this area is done, this should not be
problematic. A pair of Sandhill Cranes were observed in the same vicinity.
TCC is consulting with a Shaiptail Grouse specialist regarding potential impacts to the grouse in
relationship to the 181. drilling activities.
6MN reservoir............................................................................... 6MN reservoir
5 of 7 WHITE- File YELLOW -Operator PINK- Specialist
