(Page 2) <br />MINE ID # OR PROSPECTING ID #: m-1 gA L20 <br />INSPECTION DATE: A/15/09 INSPECTOR=S INITIALS: MAC <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety. <br />Greg Nelson and Curtis Hall of Weld County Public Works Department were also present for the inspection. <br />The Koenig Pit is located approximately 4 miles northwest of Fort Lupton, Colorado. The Koenig Pit is <br />permitted for 61.39 acres. <br />T lie permit sign was posted at file Site entrance. T lie bo Unualy was delineated on the nortl, east, and south Slues <br />by the fence line; it was delineated by monuments on the west side. No mining was taking place at the time of <br />the inspection. A front end loader was loading haul trucks in the product stockpile area. Topsoil has been <br />segregated and stockpiled at the north end of the permit area; it is also stockpiled on the west side of the site to <br />form a visual barrier along Weld County Road 25. <br />Weld County does not intend to excavate any material this year. Currently excavation is progressing northward. <br />Two dewatering trenches are channeling groundwater from the southern portion of the mine to the northwest <br />corner where it is pumped and discharged into the Meadow Island Ditch #1. The pump was in operation at the <br />time of the inspection. Any mining Operation that exposes groundwater is required to obtain a well permit and <br />Temporary Substitute Water Supply Plan from the Office of the State Engineer. In addition, the Operator must <br />have a discharge permit from the Colorado Department of Public Health and Environment. A review of the <br />Division's records found that the Division does not have a copy of the Operator's well permit, Temporary <br />Substitute Water Supply Plan, or discharge permit; please see Page 3 of this report for the required corrective <br />actions. <br />The Operator installed a slurry wall around the pit in 1999. The Operator has not provided the Division with <br />documentation that shows the State Engineer has determined the lined pit meets performance standards. Mr. <br />Nelson indicated that the slurry wall has a leak; the Operator is monitoring groundwater levels through two <br />groundwater monitoring wells on site. The reservoir is owned by the Central Colorado Water Conservancy <br />District (CCWCD). The CCWCD recently installed an inlet/outlet structure in the southeast corner of the <br />reservoir. The inlet/outlet structure was not included as part of the approved Reclamation Plan, please see Page <br />3 of this report for the required corrective actions. <br />This concluded the inspection. <br />1&E Contact Address <br />NAME: Grea Nelson cc: <br />.
