The problems should be corrected by the dates given, or they will become possible violations. The possible violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTIVE ACTIONS PROBLEM: DATE: 5/25/09 PB or PV:PV The operator/landowner failed to first obtain a reclamation TOPIC(S):AR permit before engaging in a new operation in accordance with 34-32.5-109(1) of the Colorado Land Reclamation Act for the Extraction of Construction Materials. CORRECTIVE ACTION: 1) Cease all mining related activity at the site immediately upon receipt of this inspection report and Cease and Desist Order except for those activities required to prevent damage to off- site areas or protect the public health and safety. 2) Obtain a reclamation permit within 90 days of receipt of this inspection report and Cease and Desist Order. 3) Submit the full financial warranty amount required for the approved application (File No. M-2007-035) of $35,527.00 in a form acceptable to the Division within 30 days of receipt of this inspection report and Cease and Desist Order.
