(Page 3) <br />MINE ID # OR PROSPECTING ID # M-2007-035 <br />INSPECTION DATE 04/15/09 <br />INSPECTOR'S INITIALS PSH <br />Based on the above noted disturbance and the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, there is a reason to believe that a violation of <br />Section 34-32.5-109(1) of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials may exist for failure to first obtain a reclamation permit before <br />engaging in a new operation. The operator indicated their intention to waive their right <br />to thirty (30) days notice of a hearing before the Board and have the office schedule the <br />hearing for the next Board meeting. The possible violation will be scheduled for hearing <br />at the May 13-14, 2009 Mined Land Reclamation Board meeting. Notice of such hearing will <br />be sent under separate cover. <br />An entrance sign was posted and permit boundary markers were observed as required by Rule <br />3.1.12. The west boundary is fenced. All other boundaries were marked with stakes and <br />flagging. <br />On April 23, 2009 the Division sent Glenn E.
