Explanation of Request to Amend Conditional Uses Approval Conditions <br />The Stagecoach #2 Mining/Reclamation Plan (RCU2006-00029) was approved with an expiration date <br />in 03/18/12. The applicant (LaFarge) received approval to dry-mine 1.6-2 million tons of sand/gravel <br />with on-site processing. Mining and installation of an on-site processing plant wasn't initiated, but <br />LaFarge did undertake clean up of the site, removing unnecessary fencing and other debris, stripping of <br />topsoil that is stockpiled on site's perimeter for screening, and installation of a slurry wall connected <br />with the Worthing Pit's slurry wall to the north. The approved haul routes for the estimated 450+ truck <br />trips/day were Brighton Rd. south to 124th Ave. and then east to U.S. 85. The afteruse of the site was a <br />water-storage reservoir and wildlife habitat, which was subject to future approval of an Area and <br />Activity of State Interest (AASI) for use as a reservoir. Albert Frei and Sons, Inc. (AFS) subsequently <br />acquired the property, and request deletion of hauling conditions and revision of the expiration date. <br />1. Delete Conditions Precedent #2 and Conditions 16, 17, 18, 19, 20, & 24, and Modify Condition #5 - <br />RAuirements on Improvements and Damage to Brighton Rd and 124th Ave As outlined in the <br />above first paragraph, these Conditions related of LaFarge's operations on the property, and road <br />improvements ,and repair of damage caused by hauling traffic from the property. AFS proposes to <br />combine this operation with AFS's mining operation to the north (Worthing Pit, EXG2005-00005) <br />and use in-pit hauling or conveyors to transport mined material to the Worthing Pit's plant, which <br />utilizes Brighton Rd. to 132nd Ave. to US 85 for southbound export traffic, Brighton Rd. to 136th <br />Ave. to US 85 for northbound export traffic, and 136th Ave. to Brighton Rd. to the Worthing Pit's <br />entrance for incoming traffic. Except for moving conveyors and other equipment onto the property, <br />only occasional pick-ups and passenger vehicles of employees and visitors (less than 10/day) will <br />use the Stagecoach entrance onto Brighton Rd. Since there won't be truck traffic impacts to Brighton <br />Rd. or to the intersection of Brighton Rd. and 124'h Ave., AFS requests deletion of the proposed road <br />improvements required in Conditions Precedent #2 and Conditions #16, 17, 18, 19, & 20 on <br />construction and damages to Brighton Rd. and 124th Ave., and clarification of Condition #24. <br />2. Amend Condition #9-Expiration Date of 03/18/2012 to 12/31/2015 and Revise the Expiration Date <br />on Portions of the Worthing Pit (EXG2005-00005) to 12/31/2015. In regard to the Stagecoach Stop <br />Pit, LaFarge undertook pre-mining activities and didn't initiate mining or install processing <br />equipment. The new owner/applicant (AFS) requests an extension of the expiration date to <br />12/31/2015 to complete reclamation. In addition, since material from the Stagecoach Stop Pit will be <br />transported across portions of the Worthing Pit and processed at the existing plant on the Worthing <br />Pit, and the Worthing Pit has a present completion date of 12/12/2013, it is requested to extend the <br />reclamation completion date of portions of the Worthing Pit (EXG2005-00005) until 12/31/2015. <br />In summary, the proposed amendments to both the Stagecoach Stop and'Worthing Pits are: 1. Permitted <br />in the A-3 Zone District; 2. Consistent with purposes of the County's Standards and Regulations; <br />3.Complies with requirements of the County's Standards and Regulations and applicable performance <br />standards; 4.Compatible, harmonious, and not detrimental to the character of the neighborhood, the <br />immediate area, the development of the area, or the health, safety, or welfare of the inhabitants of the <br />area or the County; 5. Addressing all off-site impacts; 6.Suitable for this use and provides usable open <br />space, adequate access, and the absence of environmental constraints; 7. Provides the most convenient <br />and functional use of the sites; and 8.Adequate for public services to serve the Conditional Use as <br />designed and proposed. Based on these facts, AFS requests a favorable recommendation from the <br />County Staff, an approval recommendation from the Planning Commission to the Board of County <br />Commissioners, and approval of the Conditional Uses Amendments requests by the Board of County <br />Commissioners. Accompanying this Explanation are a copy of the existing Conditional Use Approval <br />Conditions for the Stage Coach Pit (RCU2006-00029) with proposed changes/deletions/additions, a <br />Project Overview Map showing the relationship between the Stagecoach Stop and Worthing Pits, and <br />reduced 11" x 17" copies of the Mining and Reclamation Plans of the Stagecoach Stop Pit. <br />u <br />M <br />CL <br />IL
