RECEIVED <br />Response to Review of Storm Water Controls4Sy Allen Sorenson APR 2 1 2009 <br />Dear Mr. Means, <br />Diviaion of ReGL)mation, <br />Mir;mg and Safety <br />Nuvemco has received the list of items requiring revision to the Storm Water Controls for the above <br />referenced Monogram Mine. The requested design changes and certification by a Colorado licensed <br />professional will require additional time. Responses to Mr. Sorenson's review follows. <br />Nuvemco will defer the design and specifications for the containment of the runoff from the ore storage <br />area. Nuvemco recognizes that the design must be for the 100 year/24 hour plus the 10 year/24 hour <br />precipitation event. Nuvemco further acknowledges that this deferral will require a technical revision for <br />the design and specifications of the selected pre-fabricated containment vessel(s) and certifies that no ore <br />will be stored at that surface site until such technical revision is approved. <br />The detention pond is being redesigned to include rip rap specifications and soundness in addition to the <br />description of the fencing of the entire pond. We anticipate completion and certification of this design by <br />a Colorado professional engineer by the first of next week. <br />Nuvemco also acknowledges the final reclamation liability cost estimate and will also submit that bond <br />next week. <br />Again, we appreciate your assistance in processing Nuvemco's Monogram Mine conversion to a DMO on <br />their patented mining claims and the Monogram Mine.. <br />Sincerely, <br />O&G Environmental Consulting, LLC <br />C/ <br />E.
