<br /> <br />Backfilling and. grading, drainage reestablishment,. and surface water runoff control has <br />been demonstrated to be in compliance with the approved DRMS mining permit and <br />DRMS regulations. The final backfilling and grading configurations throughout the <br />affected areas closely resemble the approximate original contours of the land before <br />mining, and blend well into the adjacent undisturbed landscapes. <br />DRMS conducted the bond release inspection required at Colorado Rule, Section 3.03.2 <br />(2) on December 3, 2008, and DRMS notified the surface landowner and adjacent <br />landowners. OSM, BLM, and both Corey Heaps with RHINO Energy LLC and Jim <br />Stover P.E. of J.E. Stover & Associates, Inc. participated in the bond release inspection. <br />OSM has reviewed the resulting DRMS inspection report, the DRMS Proposed Decision <br />and Findings of Compliance noted above, and associated correspondence and maps used <br />during the bond release inspection. <br />This Phase I bond release. requests applies to 18.5 acres of reclaimed disturbance at the <br />--mine. Two separate areas of reclaimed-disturbance- are included-in-the bond release <br />request including.2.9 reclaimed acres at the former Loma Loadout (former railroad <br />siding, coal loadout, and previously disturbed area located at Loma, CO); and 15.6 acres <br />of reclaimed disturbance at the former mine site consisting of the former haul road, portal <br />access road, portal entries, coal waste disposal area, topsoil stockpile area, and the drill <br />rig access road. These mine site areas were reclaimed and seeded in the fall of 2007. <br />OSM finds CAM has met or exceeded the requirements for Phase I bond release on the <br />18.5 acres described above, and in the bond release inspection reports for this action. <br />DRMS currently holds a corporate surety performance bond (reclamation bond) in the <br />amount of $269,094.00. DRMS proposes to release $ 145,860.00 and has determined that <br />the remaining bond amount of $ 123,234.00 is sufficient to complete all remaining <br />reclamation work at the site if the work had to be completed by a third party contractor. <br />The remaining bond amount includes bond for topsoil redistribution and revegetation of <br />all remaining disturbed acreage at the site.
