TRANSIT MIX AGGREGATES
CASTLE AGGREGATES
March 30, 2009
Attn: Mr. Tony Waldron
V?
Q t ?t I. CCU, k"`? i
TRANSIT MIX OF PUEBLO AGGREGATES
DANIELS SAND

Division of Reclamation, Mining and Safety RECEIVED
Department of Natural Resources
1313 Sherman St., Room 215 APR 0 3 2009
Denver, Colorado 80203 00NWW of meoamation'
Dear Sir, Mi"mg and Ss"
The purpose of the letter is twofold. First to inform the division of the corrective action that has already
taken place and secondly to request a time extension for part of the second technical revision outlined in
the Division's mailing dated February 27, 2009.
Castle Concrete would also request that the hearing before the Mine Land Reclamation Board be
postponed until the May board meeting to allow CTL Thompson to conclude their investigation into the
cause of the occurrence. I will explain further in the response to Corrective Action 3.
In response to Corrective Action 1):
1. The property is already partially fenced where the majority of public access might occur.
The property was already posted with no trespassing signage however; Castle Concrete installed
25 additional warning signs 10 days after the slide. Upon receiving the letter from DRMS on
February 29, 2009 an additional 20 signs were ordered and installed as an alternative to fencing.
Please reference locations on the enclosed photo. The yellow stars on Document 1 give general
locations of the signs. Not all signs are shown on the photo as the area to the east, bottom of
photo and south, left of photo, is not shown on this photo. Document 2 shows types of signs at
various locations
There is a locked gate at the entrance of the property and Castle Concrete contracts with a
security firm that provides patrolled security seven days a week when Castle Concrete does not
have its own employees available to monitor access by the public. Document 3 shows gate along
with security vehicle
4. Castle Concrete felt the fence would not be feasible due to the large geographic area and the
ineffectiveness of fencing. The property is bordered by National Forest on the west side, and
private property on the south and north side. Castle Concrete owns the property to the east of the
slide area back to the closest public road which is over 2900 feet away.
The following comment is from the Google Earth web site comment section and is noted only to show
that Castle Concrete has attempted to maintain a secure operation.
Pete]onesl, on February 27, said:
Went hiking up here once ...not a good idea. I got kicked off the property.
CASTLE P.O. Box 2379 Colorado Springs, CO 80901 Phone: (719) 598-0215 FAX (719) 598-3053
DANIELS P.O.
