Cattany <br />Division Director <br /> Natural Resource Trustee <br />RE: Reclamation Plan Compliance, Lorencito Mine, #C-96-084 <br />Dear Mr. Thompson: <br />As you know, reclamation at Lorencito is nearing completion on most areas with <br />regarding to earth work, including backfilling, grading, topsoil reapplication, seeding, <br />mulching, and fertilization. This plan was approved by the Division in accordance with <br />Rule 2.05.4 and is included in the approved permit application on pages 2.05-55 <br />through 2.05-75. The Division has some questions and concerns related to compliance <br />with the approved plan. <br />Soil Sampling Plan <br />The approved permit text lays out a prescriptive plan with regarding to soil sampling, <br />testing, reporting and soil amendments on pages 2.05-55 and 56. Soil samples are <br />required on 500 foot centers over the reclaimed area, which is approximately 122 acres. <br />This should result in 1 soil sample for every four acres or 30 soil samples required. <br />Each sample location will consist of a sample at 0-8 inches in depth and a sample <br />below 8 inches down to 24 inches of contact with rock debris. <br />Permit text incorrectly identifies soil sample locations are shown on Map 2.05.4-1, Post <br />Mining Topography. Soil sample locations are shown on Map 2.05.3-5, Soil Sample <br />Location and Distribution Plan. Thirty-four (34) total soil sample locations are shown. <br />Results of the soil sampling are to be submitted each year in the Annual Reclamation <br />Report (permit text 2.05-56). Review of Division records indicates soil sampling without <br />fertilizer recommendations for five soil sample locations on the outslope of Fill 9, <br />submitted for the 2nd quarter of 2002. No response to the Division's letter dated <br />December 20, 2002 regarding the Division's review of these samples was received from <br />Lorencito Coal Company. <br />The Division also shows receipt of soil samples for two locations, S-28 and S-29, for the <br />reclamation completed in 2005. The two samples each tested the 0-8 inch horizon <br />only.
