N. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Reclamation, <br /> Mining and Safety. Michael Lovelady represented the operator. With the operator's consent,this report <br /> was issued from the Denver office of DRMS. <br /> Mining was active at the King II Mine in the first set of mains. Three of the four portals of the King I <br /> Mine have temporary closures. There was no activity at the open King I portal. The ground was wet in <br /> places at both sites,but ditches were mainly dry. <br /> Availability of Records <br /> The results of the records check are shown on the attached list. All required records were available. <br /> Signs and Markers <br /> King I- Mine i.d. signs and affected area markers were properly displayed. <br /> King II—A mine i.d. sign was on display at the mine's entrance on County Road 120. The perimeter <br /> of the affected area was marked with"permit boundary" signs and survey stakes. <br /> Roads <br /> King I -The mine entrance haul road was well maintained. <br /> King II -The haul/access road was well maintained. <br /> Hydrologic Balance <br /> King I Ponds - The east and west ponds contained small pools of water, several feet below the <br /> principal spillway discharge elevations. The outlet end of the secondary spillway(8"pipe) of the west <br /> pond remained exposed(soil had been removed from it during the October 2008 inspection). Sediment <br /> level markers (marked staffs)were in place,having been installed since the October 2008 inspection. <br /> Embankments, inslopes, and spillways appeared in good condition. <br /> King II Pond—The pond was dry. The pond embankment, inslopes, and spillway structure appeared <br /> in good condition. <br /> King I Ditches and Culverts - The east upland diversion ditch appeared in good condition and was <br /> clear of debris. <br /> King II Ditches and Culverts—DRMS is reviewing as-built designs of culverts and ditches that the <br /> operator submitted in TR-15. The east diversion ditch appears to be constructed in alluvial material, <br /> and the sidewalls of this ditch are near vertical in most places as it appears to have been excavated with <br /> a dozer blade. <br />
