Response: Colowyo has added text to the current permit Volume 1, Section 2.05.3 relating <br />to the removal and placement of the upper 75 feet of material on "Hink's Peak" and has <br />included two copies of the updated material for the Division's incorporation into the permit. <br />3. Many of the reclamation blocks shown on Map 29 - Spoil Grading South <br />Area, comprise large blocks of time (2009-2012 for the area of Hink's Peak, <br />for example). The lack of detail in these areas makes it difficult to determine <br />if backfilling and grading is taking place at a rate sufficient to meet the <br />scheduled completion date. The Division is requesting additional detail on <br />the map regarding the listed reclamation blocks ...This will make it easier to <br />determine compliance with the spoil grading plan and help identify any <br />potential problems. <br />Response: Colowyo agrees that the lack of detail in the reclamation blocks on Map 29 <br />makes it difficult to determine if backfilling and grading is taking place at a sufficient rate to <br />meet completion dates. However, the reasons for such ambiguity in these areas are mainly <br />due to unforeseen constraints on mining. The timing related to these blocks will vary based <br />on mine conditions and any extenuating circumstances Colowyo is confronted with such as a <br />broken dragline, tie-in boundaries that haven't been reclaimed or delays incurred in <br />reclaiming the West Pit due to a broken dragline. <br />4. Some of the areas shown on Map 29 - Spoil Grading South Area, are long <br />term facilities, such as haul roads, the facilities area and topsoil stockpiles. <br />Since these areas are not scheduled for reclamation until the end of mining <br />operations in the South Taylor Pit, it would be helpful to show these areas on <br />the map to eliminate any possible confusion related to contemporaneous <br />reclamation of these areas. <br />Response: At this time, Colowyo does not feel that it is pertinent to add text to Map 29 as <br />these long term facilities areas can be found on Map 23 - Mine Facilities and Map 28 - <br />Topsoil Handling which are currently located within the permit and are available for the <br />Division's reference. <br />This completes Colowyo's first round of responses to the Division's preliminary <br />adequacy review. Colowyo is looking forward to learning the outcome of the <br />Division's proposed decision date on 24 April 2009.
