Stark <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: Colowyo Mine's response to the Division's Preliminary Adequacy Review <br />for Technical Revision - 79. <br />Dear Mr. Stark, <br />Colowyo received the Division's preliminary adequacy comments toward TR-79 on <br />13 March 2009 and has the following comments and responses. <br />Rule 4.14 Backfilling and Grading <br />On 4 March 2009, the Division received an additional page to the Technical <br />Revision 79 submittal titled "Current Topography vs. PMT"...the Division <br />would like Colowyo to provide text in the backfilling and grading section of the <br />permit that describes the current backfilling activities... Please provide a <br />narrative description of the truck dump planning in the West Pit as it relates to <br />the backfilling and grading operations and contemporaneous reclamation in <br />Permit Section 4.14. In the narrative, please include how, following the <br />dumping operations, final backfilling operations will be accomplished (at <br />present Colowyo has discussed final grading operations with both dozers and <br />dozers assisting a dragline) and the timing of these activities. <br />Response: Colowyo has added text to the current permit Volume 1, Section 4.14. relating <br />to backfilling and grading operations and contemporaneous reclamation in the West Pit and <br />has included two copies of the updated material for the Division's incorporation into the <br />permit. <br />2. In Technical Revision 63 (approved on 1 June 2007), Colowyo committed to <br />remove the upper 75 feet of "Hink's Peak" (to an elevation of approximately <br />7,400 feet). Because the removal and placement of this material represents <br />a relatively large task, removal of approximately 3,200,000 cubic yards of <br />material, the Division believes this task needs to be addressed in the permit. <br />Please describe how the removal of this material will be accomplished, <br />where, specifically this material will be placed and when this operation will <br />take place.
