Section III. - Status of Stipulations <br />According to the Division's records in the permitting database, there are no outstanding <br />stipulations attached to Permit No. C-1984-065. All stipulations have been complied <br />with and terminated prior to Permit Renewal 05. <br />Section IV - Permit Variances <br />There are no variances to the permit under Rules 2.06.2(10), 2.06.3(4), 2.06.5(3), and <br />2.06.7(5). <br />Section V. - Decision to Require Revisions or Additional Information <br />Based on a review of the permit application, the Division has the following questions for <br />CD Minerals. The Division requests responses from CB Minerals by 31 May 2009. The <br />responses will need to be submitted in the form of a revision to the permit. <br />1. Please update all the information in Section 2.2, Identification of Interests, <br />including the owners and controllers information, as necessary. <br />2. Please update Section 2.4, Right of Entry and Operation, as necessary. <br />3. Please update Section 2.6, Permit Term Information, to include the current <br />permit term information. <br />4. Please update Exhibit 2.7-1, Insurance Information, in the permit. <br />5. Please update Exhibit 2.11-1, Certificate of Deposit, with the current CD <br />information from Wells Fargo Bank. <br />6. Please update Section 3.7.6, Threatened and Endangered Species in the <br />permit application and confirm to the Division in writing that all <br />threatened and endangered species and candidate species and their habitats <br />listed for Garfield County have been discussed and evaluated. If not, a <br />new survey will need to be performed for this Midterm Review using the <br />current list of threatened and endangered and candidate species for <br />Garfield County. If a new T&E survey is performed, the Division will <br />forward it to the OSM and they may send it to the US Fish and Wildlife <br />Service for a Section 7 consultation. Failure to include candidate species <br />could result in mine closure if the species is listed in the future.
