Review
Dear Mr. Davis,
On February 23'd, 2009 the.-Division received your request for a Technical Revision for
the above referenced mine site. The decision date'for this revision is March 25th, 2009.
There are several issues that will need to be addressed prior to the approval of this
Revision. If you need more time to respond to this review please request an extension for
the decision date for this revision. Please keep in mind, that the Division will need time
to review your response. If there are still outstanding issues that have not been resolved
by the decision date and an extension has not been requested, the Technical Revision will.
be denied.
Introduction:
For clarity purposes, the following section describes what the Division perceives as the
current status of the mine site and the various definitions that are used for-this mine, site.
Hopefully this process clarifies what the current parameters permitted for this site are and
what information needs to be updated.
First, to summarize what you are requesting in your current Technical Revision... about 21
acres of land that was potentially to be affected during the mining operation will no
longer be potentially affected due to the fact the an endangered butterfly may be present
in the area to. be removed.
In Amendment 03, you offered:the following definitions for categories of acreage
involved' in the mining operation:
