Umetco contends that no activity has <br />been conducted on the Burro #3 shaft since before 1981 and therefore, is not subject to 43 CFR <br />§3809. <br />I contacted you on March 10, 2009, by phone to discuss the Bureau of Land Management's <br />(BLM) concerns.. As I stated, BLM records show that the Union Carbide Corporation requested, <br />and BLM issued several Special Land Use Permits (SLUPs) for the waste dumps, #s 3, 5, and 7 <br />to Union Carbide in the 1970's. As an example, Union Carbide Corporation submitted a SLUP, <br />dated May 11, 1973. In Section 6.b, Union Carbide has stated that: <br />"When mining operations are completed the piles will be contoured to avoid erosion and <br />restoration of natural vegetation will be assisted by seeding where feasible." <br />Furthermore, the stipulations that were issued with the SLUP state: <br />"The lessee shall be required to take all reasonable steps to rehabilitate the dump areas to <br />a useful and productive condition consistent with pre-existing land uses in the area or to <br />such other uses as the District Manager may determine. Rehabilitation may take, but is <br />not limited to, the form of the following: leveling, backfilling and revegetation of spoil <br />banks and pit areas consistent with the latest practices of sound restoration methods. The <br />reclaimed land will be left in a useful, nonhazardous condition that holds soil erosion and <br />water pollution at a minimum." <br />A copy of the SLUP has been attached for your convenience. <br /> <br />as IV
