III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division)on 25 March 2008. The weather was cloudy and the mine <br /> site was wet with recent snowfall during the on-the-ground inspection of the site. Scott Wanstedt of <br /> BME accompanied the inspection. <br /> The mine is currently operating as permitted. No drilling activities were in progress during the <br /> inspection. <br /> The Deserado mine provided a copy of the information sent to the Bureau of Alcohol, Tobacco and <br /> Firearms concerning a new explosives magazine located at the approved explosives storage area <br /> SAE. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were inspected at the Deserado Mine site <br /> office. <br /> Roads <br /> The paved Deserado Mine Road appeared to be well maintained and in good condition. The haul <br /> road from the facilities area to the refuse disposal area was wet and stable and displayed good <br /> drainage with no problems noted. The conveyor corridor road, access roads and light-use roads were <br /> wet with patches of snow cover and in good condition with no problems noted. All roadside ditches <br /> and diversions were snow covered at the time of the inspection. <br /> Hydrologic Balance <br /> The DP-1 Pond contained a small amount of water with no discharge noted. The construction of the <br /> riser pipe is complete with the addition of a walkway to be installed. The pond embankment appeared <br /> stable and well vegetated. The emergency and primary spillways were in compliance with no <br /> problems noted at the time of the ins action <br /> � F <br /> r. <br /> i "IS <br /> DP-1 Riser <br />
