• <br /> <br />Mine in the year preceding August 3, i 977, are provided in Colorado Division of <br />Mines reports contained in Appendix 21-3. <br />Geographic Extent <br />The "License to Operate Coal Mine" for each of the Roadside North and <br />Roadside South Mines are the basis to define the geographic extent of the <br />exemption. The base area defined by these documents is Sections 27, 28, 33, <br />and 34, T10S, R98W. <br />A substantial financial and legal commitment was established effective <br />December 16, 1976, when General Exploration Company entered into a legal <br />agreement with Mississippi Power Company "to develop and construct a mine <br />and mine coal from the Coal Property and to construct or otherwise provide <br />loading facilities capable of loading at the rate required to comply with this <br />agreement...". The lands committed in this agreement, the "Coal Property", <br />were shown in Annex A of the Agreement of which relevant parts are contained <br />in Appendix 21-6. <br />The total area which should be considered in determining the geographic extent <br />of the exemption is depicted in Exhibit 33. <br />• 21-5 (NEW 3/1/96) <br />
