• The rail loop and a portion of the rail spur will be left in place since it will be the <br />key feature for the industrial use of the area. The concrete conveyor tunnel, the <br />concrete foundations of the pump house, and the loadout's motor control center <br />foundation will be left in place. The concrete tunnel will be used as a storage <br />facility and the foundations will be used to build a construction field office and <br />storage building. All other structures will be removed except the sediment pond <br />spillway which will be capped. Implementation of the following Phase 2 items of <br />the land use change will demonstrate that the alternative land use has <br />substantially commenced and is likely to be achieved. <br />1. Installation of the multimillion dollar sand plant. <br />2. Initiating construction of the bridge and new access road. <br />3. Configuration of the reclaim tunnel as a storage facility. <br />The site will be used by Halliburton as a support facility for the western oil and <br />gas fields. Drilling in the Western United States has increase dramatically in the <br />last several years and this trend is expected to continue. This site will continue <br />to be used to support and maintain existing wells even if gas drilling subsides. <br />The activities associated with this land use change will be regulated by Mesa <br />County. As such, the activities are regulated to assure there is no actual or <br />probable hazard to public health or safety nor will it pose actual or probable <br />• threat of water flow diminution or pollution contrary to State or Federal laws, <br />Rules or Regulations. The site will be secured to stop unauthorized entry which <br />will safeguard the public from industrial hazards. Mesa County has certain rules <br />regarding run-off from industrial sites that will eliminate any actual or probable <br />threat of water flow diminution or pollution contrary to State or Federal laws, <br />Rules and Regulations. <br />The land uses adjacent to the rail spur and unit train loadout are industrial (UP <br />Mainline and Xcel Power Plant) and fish and wildlife habitat (areas north and <br />east). The proposed use of the loadout and a portion of the rail spur is an <br />industrial use which is compatible with the surrounding industrial uses. <br />Exhibit 62 shows the pre-mining land use within the affected and adjacent area. <br />Exhibit 63 shows the post-mining land use. <br />With the exception of the Colorado Division of Reclamation, Mining and Safety <br />and the Mesa County Department of Planning and Development, no other state <br />or local agencies' authorizations are required to achieve the post-mining land <br />use described above. <br />• PR-4 15-2 New 12/08 <br />
