• <br />2.05.5 Post Mining Land Uses <br />(2) After the reclamation activities described in Section 2.05.4, Tab Section 14 are <br />completed, most of the lands affected by surface operations and facilities within <br />the permit area will have been returned to their original pre-mining condition, <br />which, as described in Section 2.04.3, Tab Section 4, was "fish and wildlife <br />habitat" according to Rule 1.04(71)(h). <br />The South Portal, including the top of the Roadside Refuse Disposal Area, was <br />converted to commercial use (PR-3) for a fruit storage, packing and retail sales <br />location, and is now owned by Providence Place Inc. (PPI). Since 2005 PPI has <br />been using the warehouse 8~ shop on the upper level as equipment & material <br />storage, the lab building is being used as the sales location, the cafeteria on the <br />lower level houses a refrigeration unit and package area, and the block lab <br />building on the lower level is used for material storage. Appendix 15-2 shows <br />the minor site plan and approval by the Mesa County Department of Planning <br />and Development. <br />The Overland Conveyor south of 19/10 road was converted to industrial use for <br />the Union Pacific Railroad (UPRR) and Xcel Energy (TR-57). Xcel's haul road, <br />which is located on their property and used for coal deliveries, is located in the <br />NE section of this area. Since completion of reclamation and revegetation of the <br />Overland Conveyor in 2004, the UPRR's employees and contractors, with no <br />consideration to SCC's revegetation attempts, continue to use this area for <br />access to the rail for maintenance and to store materials and equipment when <br />repair jobs are being performed. <br />The unit train loadout and portion of the railroad spur and overland conveyor <br />corridor, north of 19/10 Road, will be converted to industrial/commercial use. The <br />Operator has a purchase and sale agreement with Halliburton that will use the <br />loadout and a portion of the railroad spur and overland conveyor as an industrial <br />site. Closing on the purchase and sale agreement is subject to, among other <br />items, obtaining approval of a land use change from the DRMS. As depicted on <br />Exhibits 10C & 11 C, the proposed industrial use will be implemented in "phases°. <br />Phase 1 consists of a temporary offloading pad along Union Pacific's house <br />track to offload sand into trucks for immediate delivery. Phase 1 has been <br />implemented, which required the removal of approximately 26 sections of the <br />existing rail loop. These sections will be replaced in conjunction with the Phase 2 <br />sand plant construction. Phase 2 consists of constructing a bridge over Coal <br />Creek, new access road, construction of a sand plant, additional railroad sidings, <br />barite storage, new Individual Septic Disposal System (ISDS) and use of the <br />existing tunnel, two foundations and rail. Phase 3 consists of constructing a new <br />scale/turnaround area and warehouse/office and Phase 4 consists of <br />constructing additional building(s). <br />• PR-4 15-1 Rev 12/08 <br />
