III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete quarterly inspection of the reclaimed Fruita mine permit revocation site, <br /> conducted by Dan Mathews of the DRMS Grand Junction Field Office, accompanied by Erica Crosby <br /> of the Division's Inactive Mine Program (IMP). IMP developed the maintenance plan and bid <br /> documents for the project, utilizing a combination of remaining forfeited bond funds and a grant from <br /> the OSM civil penalties fund. The contractor was on site and had initiated the project earlier this week. <br /> Construction of the riprapped drainage channel extending from the base of the steep #1 bench <br /> outslope was in progress during the inspection. Grading and rock check installation had previously <br /> been completed on gullies along the lower access road and on the lower portion of the #1 bench <br /> outslope, east of the main channel. <br /> Additional work specified under the current project plan includes stabilization/armoring of the #1 portal <br /> backfill, removal of the existing sediment pond spillway riser structure that is no longer functional, <br /> sealing of the existing spillway culvert, and lowering/stabilizing the open channel spillway. Erica and I <br /> identified additional tasks to be undertaken as funding allows, including riprap drainage stabilization in <br /> several locations, installation of a number of rock check structures in mine affected drainages, <br /> enlargement of an existing diversion above the #1 bench outslope, roughening and seeding the <br /> smoothly graded #2 portal backfill where seeded vegetation did not establish well, and removal of <br /> tamarisk in the sediment pond. All of the areas disturbed by project work this spring will be roughened <br /> and seeded immediately after completion. The #2 portal backfill area and additional areas if a <br /> reseeding is determined to be warranted will be seeded in the fall. <br /> Weather was clear and mild, surface soils were moist. The sediment pond contained no water; pond <br /> bottom was dry. <br /> Signs and Markers <br /> The DMG revoked permit I.D. sign is still present on the old gate at the site entrance. The condition is <br /> unchanged from previous inspections; damaged by bullet holes but Division phone number remains <br /> legible. <br /> Hydrologic Balance and Backfill & Grading <br /> Sediment pond and associated spillway structure were as described in reports dating back to <br /> November 2006. The pond bottom was moist, but due to the deteriorated condition of the primary <br /> spillway at the joint of the vertical (riser) and horizontal CMP sections of the structure, the pond does <br /> not retain water. This problem will be corrected by the project currently in progress. <br /> Erosional features along various reclaimed drainages, the lower access road, and the #1 portal backfill <br /> slope (described in previous inspections) will be repaired during the maintenance project currently in <br /> progress. <br /> 3 <br />
