IV. ENFORCEMENT ACTIONS
The following identifies enforcement actions taken during this inspection, the required abatement and
date of abatement for the violation, previous violations still requiring abatement and the termination of
violations cited during previous inspections.
NOV CV-2009-001 was issued on February 27, 2009 for failure to minimize erosion and resultant
siltation beyond the disturbed area. The area of concern was at the entrance to the Bowie No. 1 East
Mine. The abatement work for the NOV was to install and maintain effective erosion and sediment
control measures to minimize siltation beyond the disturbed area. The abatement deadline for this
work was March 5, 2009. A design drawing and digital images of the completed work had been e-
mailed to the Division on March 5, 2009. This field inspection verified that the work had been
completed. NOV CV-2009-001 was, therefore, terminated on March 17, 2009.
