III. COMMENTS-COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. The purpose of this inspection was to examine the abatement work that had been done for NOV CV-2009-001 and terminate the NOV if appropriate.The NOV was issued for failure to minimize erosion and resultant siltation beyond the disturbed area.The operator had removed the asphalt from the haul road past the entrance gate as part of the reclamation of the Bowie No. 1 East Mine but did not properly install sediment control structures at the entrance to the site off of Steven's Gulch road. Due to a precipitation event,runoff from the dirt haul road had transported sediment offsite. The abatement work for the NOV was to install and maintain effective erosion and sediment control measures to minimize siltation beyond the disturbed area. As abatement for the NOV,the operator installed a series of straw bales in the north side road ditch to filter sediment out of any runoff before it leaves the site. The straw bales were spiked into the ground to secure them in place.In addition,a swale was constructed diagonally across the road from south to north to channel runoff from the dirt road into the north side road ditch.A second swale was constructed diagonally across the road from north to south to bring road runoff into a containment area located by the entrance gate.A row of straw bales was placed in front of the containment area to filter runoff before leaving the site. The abatement deadline for this work was March 5, 2009.A design drawing and digital images of the completed work had been e-mailed to the Division on March 5, 2009. This field inspection was to verify that the work had been completed.NOV CV-2009-001 was,therefore,terminated on March 17, 2009. c:/word/bowie 1/insp03 09
