III. COMMENTS - COMPLIANCE Eagle Mines C-1981-044 20 March 2009<3:!� Pg 1/2 Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a complete inspection of the Eagle Mines conducted by Jim Stark of CDRMS. Joe Shoemaker of BTU-Empire accompanied me on the inspection. The mine is currently in temporary cessation and is only performing maintenance and monitoring activities. The inspection was conducted on the morning of 20 March 2009. The weather was warm and overcast and the ground was dry. All of the snow had melted from the entire site at the time of the inspection. Availability of Records: All of the necessary records were available. The records were brought to the inspection in three-ring binders by Joe Shoemaker. Please see the DBMS Availability of Records form at the end of this inspection for more detailed information. Signs and Markers: - All of the necessary signs were in place as required. The entrances along Colorado Highway 13 all have their appropriate signs. Stream buffer zone (and buffer zone exemption) signs were also in place as required. All of the topsoil piles inspected had the proper signage. Roads: - The mine access road was dry and in good condition. The road is well maintained and appeared stable at the time of the inspection. There were no erosional problems noted on the road at the time of the inspection. - The access roads on the east side of the mine were all dry. All of the roads were well maintained and appeared to be stable at the time of the inspection. Hydrologic Balance: - The Mine 5 dewatering ponds, 5-P5, 5-P6 and 5-P7, all contained water and were all stable and well vegetated at the time of the inspection. The ponds were discharging into the Williams Fork at the time of the inspection. There did not appear to be any muskrat holes or erosional problems in the pond embankments at the time of the inspection. - Sediment Ponds 9-P7 and 9-P8, by the old B&S building, were both dry at the time of the inspection. The pond embankments were all well vegetated and stable at the time of the inspection and there were no signs of erosion. - Sediment Pond 9A-P1 was dry at the time of the inspection. The pond embankment was well vegetated and appeared to be stable. No erosional problems were noted on the pond embankment at the time of the inspection. - Sediment Ponds 9-P2 and 9-P3 are a series of ponds on the east side of the site for old, reclaimed areas. Both ponds were dry at the time of the inspection. Both pond embankments were well vegetated and appeared to be stable at the time of the inspection. No erosional problems were noted on either pond embankment at the time of the inspection.
