Below are comments on the inspection. The comments include discussion of observations
made during the inspection. Comments also describe any enforcement actions taken during
the inspection and the facts or evidence supporting the enforcement action.
This was a complete inspection of the Colowyo Mine conducted by Jim Stark of
CDRMS. The inspection was conducted on 18 and 19 March 2009. Jennifer Sekulski of
CCC accompanied me on the inspection on 18 March 2009 and Ryan Pawlowski
accompanied me on the inspection on 19 March 2009. The mine was actively
mining coal and hauling coal to the loadout at the time of the inspection. The
weather was warm and sunny and there only snow on the ground in low-lying areas
like ditches and north-facing slopes. Most of the ground on the site was also dry at
the time of the inspection.
On the morning of 19 March 20091 met with the members of the Colowyo
environmental staff (fay Tonozzi, Kurtis Blunt, Jennifer Sekulski and Ryan Pawlowski)
regarding the outstanding revisions at the site.
TR-72 - Reclamation Plan: We briefly discussed the Division's third adequacy
review letter. In particular we discussed adequacy question 3, which deals
with a plan for and verification of the variable topsoil replacement depths
proposed in the plan. We discussed an acceptable way to present the
information in the permit text and maps as well as how to report/verify the
topsoil replacement in the Annual Reclamation Report. Colowyo indicated
that they were OK with the other adequacy questions.
TR-73 - Curve Numbers: We discussed the second adequacy letter that was
sent out on 16 March 2009. In particular we discussed the need to change the
soil type in the SEDCAD runs and to provide site-specific data to justify the
curve numbers for 1-2 year growth areas. We also discussed the need to
replace permit text related to the pumping and discharge of pit water through
sediment ponds during storm or snowmelt events.
TR-77 - Highwall Mining: We discussed each of the preliminary adequacy
questions one at a time and Colowyo provided clarification of the Highwall
mining. Colowyo is only planning on mining the E-Seam with highwall mining
methods, which will be clarified in the associated text. Additionally, Colowyo
will provide more detail regarding the mining areas and the undermining of the
permanent spoil fill pile.
TR-78 - Prospect Drainage Hydrology: We briefly discussed the Division's
preliminary adequacy letter and Colowyo is waiting for the approval of TR-73
to complete their comments.
