III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 18 March 2009 <br /> Pg 1/7 e50t7r <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br /> CDRMS. The inspection was conducted on 18 and 19 March 2009. Jennifer Sekulski of <br /> CCC accompanied me on the inspection on 18 March 2009 and Ryan Pawlowski <br /> accompanied me on the inspection on 19 March 2009. The mine was actively <br /> mining coal and hauling coal to the loadout at the time of the inspection. The <br /> weather was warm and sunny and there only snow on the ground in low-lying areas <br /> like ditches and north-facing slopes. Most of the ground on the site was also dry at <br /> the time of the inspection. <br /> On the morning of 19 March 20091 met with the members of the Colowyo <br /> environmental staff (fay Tonozzi, Kurtis Blunt, Jennifer Sekulski and Ryan Pawlowski) <br /> regarding the outstanding revisions at the site. <br /> TR-72 - Reclamation Plan: We briefly discussed the Division's third adequacy <br /> review letter. In particular we discussed adequacy question 3, which deals <br /> with a plan for and verification of the variable topsoil replacement depths <br /> proposed in the plan. We discussed an acceptable way to present the <br /> information in the permit text and maps as well as how to report/verify the <br /> topsoil replacement in the Annual Reclamation Report. Colowyo indicated <br /> that they were OK with the other adequacy questions. <br /> TR-73 - Curve Numbers: We discussed the second adequacy letter that was <br /> sent out on 16 March 2009. In particular we discussed the need to change the <br /> soil type in the SEDCAD runs and to provide site-specific data to justify the <br /> curve numbers for 1-2 year growth areas. We also discussed the need to <br /> replace permit text related to the pumping and discharge of pit water through <br /> sediment ponds during storm or snowmelt events. <br /> TR-77 - Highwall Mining: We discussed each of the preliminary adequacy <br /> questions one at a time and Colowyo provided clarification of the Highwall <br /> mining. Colowyo is only planning on mining the E-Seam with highwall mining <br /> methods, which will be clarified in the associated text. Additionally, Colowyo <br /> will provide more detail regarding the mining areas and the undermining of the <br /> permanent spoil fill pile. <br /> TR-78 - Prospect Drainage Hydrology: We briefly discussed the Division's <br /> preliminary adequacy letter and Colowyo is waiting for the approval of TR-73 <br /> to complete their comments. <br />
