(Page 2) <br />MINE ID # OR PROSPECTING ID #: mod-1987-166 <br />INSPECTION DATE: 9/96/474 INSPECTOR=S INITIALS: MAC' <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety. Jim <br />Westhoff was also present for the inspection. The Westhoff Farms Pit is located in Morgan County approximately <br />10 miles south of Wiggins, Colorado. The site is permitted for 5 acres. <br />This inspection was part of the Division's regular monitoring program. The permit sign was posted in accordance <br />with Rule 3.1.12. The northwest permit boundary was not posted; Mr. Westhoff posted the missing boundary <br />marker during the inspection. The site was traversed with a GeoXT Global Positioning System (GPS) unit. The <br />collected data was downloaded into GPS Pathfinder Office 3.10 software. The disturbed area was determined <br />to be 3.93 acres. The permit boundary was delineated by posts on the northwest and southwest corners and <br />County Road 3 on the east side. The current configuration of the permit boundary was determined to be <br />approximately 7.3 acres in size. The site is permitted for 5 acres which means that the permit boundary has <br />been incorrectly delineated. The Division reviewed the permit file and could not find an adequate map or legal <br />description of the site. This has been cited as a problem and will require corrective action by the Operator. <br />There was no mining taking place at the time of the inspection; no mining equipment was present. Mining is <br />currently progressing to the west into a hillside. A highwall runs from the north to the south and is approximately <br />400 feet in length and 22 feet high. The southern edge of the highwall has been graded to 4:1. There was a <br />product stockpile located near the south end of the highwall. The Division holds a bond in the amount of <br />$3,000.00, which was determined to be sufficient to complete reclamation. <br />The presence of a power transmission line was noted during the inspection. The line is located on top of the hill, <br />to the west of the highwall. The highwall is approximately 192 feet from the power transmission line. Rule 6.3.12 <br />states that when the mining operation is within 200 feet of any significant, valuable and permanent man-made <br />structures, the Operator shall provide the Division with a notarized letter from the utility stating that the mining <br />and reclamation activities will have no negative affect on their utility. The Operator may also provide the <br />Division with a notarized agreement with the utility, stating that the Operator will provide compensation to the <br />structure owner in the event the structure is damaged. The Division reviewed the permit file and could not find <br />a letter from the utility or an agreement between the Operator and utility. The Operator shall not mine any <br />closer to the power transmission line until the Division receives a damage waiver agreement or a letter from the <br />utility.
