LEGAL DESCRIPTION <br />EXHIBIT A <br />The site is approximately 2 miles west of Mancos. A legal description of the permit boundary is <br />shown on Map C-1 which is included in Appendix D. A general location map is enclosed as Map <br />B-1 in Exhibit B. The total permit area is 94.00 acres. <br />LEGAL DESCRIPTION <br />A tract of land located within the northwest quarter of Section 31, Township 36 North, Range 13 <br />West of the 10th Principal Meridian, Montezuma County, State of Colorado and being more <br />particularly described as follows: <br />Commencing at the northwest corner of said Section 31, <br />thence S 01°06'38" W a distance of 982.74'; thence S 01°04'51" W a distance of 1610.63'; <br />thence N 58°26'19" E a distance of 940.14';thence N 57°13'04" E a distance of 1665.96'; <br />thence N 00°14'24" E a distance of 141.07'; thence N 00°04'37" W a distance of 1027.53; <br />thence N 89°11'46" W a distance of 2151.69'; <br />which is the point of beginning, having an area of 94.00 acres <br />The permit area is owned by Eldon, Linda and Andrew Simmons. <br />The above described property is to be used for gravel source, roads, stockpiles and plant <br />facilities. <br />i <br />Simmons Pit, March 2009 A-1
