Division Response <br />Issues related to land use and the resulting impacts to property values are regulated by <br />Prowers County and the Town of Lamar, not the Division of Reclamation, Mining <br />and Safety. <br />5. Railroad Lines <br />The following objectors raised concerns on how the proposed rail spur would <br />impact the area. <br />• Daniel, David, Milford and Valeta Rasmussen <br />Division Response <br />The Applicant has changed the location of the proposed rail spur to allow easier <br />access from County Road HH.5 to the Town of Lamar. In addition, the proposed rail <br />corridor is intended for non gravel product uses. Issues related to land use are <br />regulated by Prowers County and the Town of Lamar, not the Division of <br />Reclamation, Mining and Safety. <br />III. DIVISION RECOMMENDATION <br />It is the Division's determination that the Application has fulfilled the requirements of the <br />proposed permit for the West Farm Pit M-2008-078. Therefore the Division recommends approval <br />of the permit. <br />4
