B. ISSUES RAISED THAT THE DIVISION BELIEVES ARE NOT WITHIN THE <br />JURISDICTION OF THE DIVISION OR BOARD <br />1. Air Quality <br />The following objectors raised concerns on how the operation may impact air quality in <br />the area: <br />• Daniel, David, Milford and Valeta Rasmussen <br />• Irene Aragon and The Gonzalez's <br />Division Response <br />Air quality is regulated by the Colorado Department of Public Health and <br />Environment (CDPHE), not the Division of Reclamation, Mining, and Safety. The <br />applicant has indicated that a permit will be obtained from CDPHE related to air <br />quality at the site. <br />2. Noise <br />The following objectors raised concerns on how the project may increase noise in the <br />area: <br />• Daniel, David, Milford and Valeta Rasmussen <br />• Irene Aragon and The Gonzalez's <br />• Mrs. Hoss Inman <br />Division Response <br />Noise issues related to the operation fall under the jurisdiction of Prowers County and <br />the Town of Lamar, not the Division of Reclamation, Mining and Safety. <br />3.
