M-2008-078 - GP Ranches, LLC - West Farm Pit - 112 (c) Application Adequacy Review 01 Response <br />March 17, 2009 <br />-3- <br />A letter is attached acknowledging that GP Ranches, LLC has an SPCC plan in place and will <br />implement it prior to the storage of fuel or oil products at the West Farm Pit. <br />8. Specify whether explosives will be used during mining per Rule 6.4.4(1). <br />Explosives will not be used during mining. <br />9. The Mining Plan states that a portion of the mining area lies in the floodplain of the Arkansas <br />River. There is a possibility that water could enter the pit during a flood event, resulting in <br />headcutting of the highwall. The Division asks that you consider implementing measures to <br />prevent waterfront entering the pit during such an event. <br />The site is located in Prowers County. The Southeast Land and Environment division of <br />Prowers County is the local floodplain administrator, and works with FEMA to regulate issues <br />related to land use/development in flood prone areas of the County. GP is required to obtain a <br />Flood Hazard Development Permit from Prowers County for the gravel pit as part of the <br />County's Special Use Permitting process prior to any mining or reclamation activities <br />commencing. GP must demonstrate to the floodplain administrator that the operation will not <br />adversely affect the floodplain, will not increase the flood risk on adjacent properties, and will <br />implement appropriate mitigation measures to protect the mine and adjacent lands during <br />significant flood events in order to receive approval for this permit. <br />10. The Mining Plan states that 2 phases will be disturbed at any given time. Describe the point of <br />maximum disturbance for each phase. Please include enough detail so that the Division can <br />calculate the maximum interior highwall dimensions that will require reduction to a 3:1 slope. <br />This information is necessary to assist us with our financial warranty calculation. <br />The maximum disturbed area for each individual phase extends to its boundary shown on the <br />Exhibit C Pre-Mining/Mining Plan Map. Because reclamation is planned to occur on previous <br />phases concurrently with the mining of each subsequent phase, the maximum disturbed area at <br />any given time will be 2 phases. We have provided for financial warranty to be provided for the <br />liner required to close the mine at any given time in our phased financial warranty calculations. <br />We did this to ensure that the Division has sufficient warranty posted for any given time during <br />the life of the mine even though GP will only construct liner located on the perimeter of all <br />phases.
