III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
Ponds
• Pond 001 was dry, with the exception of a layer of snow covering the bottom.
• Pond 002 (Figure 17) contained water at an-elevation below that of the primary spillway. It
appeared that the water level had recently been higher, but possibly not high enough for
discharge to occur.
• Pond 003 also held water (Figure 18), and discharge had apparently recently occurred. At
the downstream side of the bin wall dam, standing water was observed (Figure 19).
• Pond 004 also contained some water, recent discharge appeared to be unlikely (Figure 20).
Reclamation Success
• The riprapped channel constructed down the reclaimed slope that crosses the former
Crushing / Screening bench appeared to have received and transported flow during the
recent precipitation event (Figure 21). The channel appeared to have functioned as
designed, and there was no evidence that the flow departed from the channel.
• Slopes reclaimed during 2008 appear to be stable, with no sign of erosion having occurred
(Figure 22).
Timber Storage Area
• Water retained in the Sediment Pond was observed from a distance (Figure 23).
• Silt fence protecting Stevens Gulch from any.erosion that may occur on the reclaimed area
appears to have held up well through the winter season (Figure 24). BRL stated they will
inspect the fence, and repair/ maintain as necessary.
This concludes the inspection report for the Bowie No. 1 Mine on 25 February 2009.
Bowie No. 1 Mine C-1981-038 25-Feb-2009
-3-
