Albert <br />Agile Stone Systems, Inc. <br />6435 South Pontiac Court <br />Englewood, Colorado 80111 <br />Dear Mr. Albert: <br />This is in reference to your proposal to construct two <br />bridges in Tallahassee Creek near Parkdale, Fremont County, <br />Colorado (Action No. 1997 30215). <br />The Corps of Engineers has published Nationwide Permits <br />pursuant to Section 404 of the Clean Water Act (33 CFR 330). <br />Nationwide Permit No. 14 authorizes discharges of dredged or fill <br />materials into waters of the United States for road crossings. A <br />summary of Nationwide Permit No. 14 is enclosed for your <br />information. <br />Your road crossings can be constructed under authority of the <br />nationwide permit. The permittee must insure compliance with all <br />conditions of the permit, including submittal of the enclosed <br />Compliance Certification required by General Condition No. 14. <br />Any discharges of dredged or fill material into wetlands <br />requires notification to this office (see General Condition 13 of <br />the nationwide permit). Notification is also required if you <br />combine this nationwide permit with another nationwide permit <br />No. 12 through 40. You cannot combine this nationwide permit <br />with No. 18 or 26 for the purpose of increasing the footprint of <br />the road crossing. <br />General Condition No. 11 requires that no activity is <br />authorized under any Nationwide Permit which is likely to <br />jeopardize the continued existence of a listed or proposed <br />threatened or endangered species, as identified under the Federal <br />Endangered Species Act, or which is likely to destroy or <br />adversely modify the critical habitat of such species.
