III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Processing Waste <br /> The temporary coal waste pile area was inspected and found to be properly maintained. The berm <br /> around the waste pile is well maintained and The temporary waste pile is nearing its capacity. The <br /> pile appears to have reached approximately two-thirds of its total capacity. On March 2, 2009 the <br /> DRMS issued its proposed decision to approve Technical Revision No. 16 for the construction of a <br /> new larger waste pile and a new sediment pond. The new gob pile has been designed to sufficiently <br /> handle all additional processing waste that may be generated by the McClane Canyon Mine. <br /> Support Facilities <br /> The shop and facilities areas were muddy but well kept. Perimeter areas at these locations were <br /> maintained, and no problems were noted at the shop or facilities area during this inspection. <br />
