III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
Processing Waste
The temporary coal waste pile area was inspected and found to be properly maintained. The berm
around the waste pile is well maintained and The temporary waste pile is nearing its capacity. The
pile appears to have reached approximately two-thirds of its total capacity. On March 2, 2009 the
DRMS issued its proposed decision to approve Technical Revision No. 16 for the construction of a
new larger waste pile and a new sediment pond. The new gob pile has been designed to sufficiently
handle all additional processing waste that may be generated by the McClane Canyon Mine.
Support Facilities
The shop and facilities areas were muddy but well kept. Perimeter areas at these locations were
maintained, and no problems were noted at the shop or facilities area during this inspection.
