III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the McClave Canyon Mine conducted by Mike Boulay of the <br /> Division of Reclamation, Mining and Safety(DRMS) on March 9, 2009. Rodney Head the Safety <br /> Director for McClane Canyon Mining LLC (MCM) was present during the entire inspection. Weather <br /> conditions were cloudy and cool. Ground conditions were damp. Coal was being conveyed and <br /> hauled from the mine at the time of the inspection. A loader was actively working at the coal stockpile <br /> in preparation for loading and hauling. There is excess coal in the stockpile right now due to a reduced <br /> amount being hauled from the mine. The coal stockpile is shown in Photo No. 1. <br /> Availability of Records <br /> The availability of records was checked at the mine office on the afternoon of March 91h. Seethe <br /> attached records checklist at the end of this inspection report. All required records were on file and <br /> available for review with exception of the 2008 Annual Reclamation Report, and the 2008 Annual <br /> Hydrology Report. Please update the mine site records with these documents. <br /> Roads <br /> Roads were maintained and in good condition throughout the site. Road ditches are adequately <br /> maintained. Culverts were clear of sediment and debris and functioning properly. <br /> Hydrologic Balance <br /> Drainage structures and diversion culverts in the portal area were clear of debris and appeared to be <br /> functional. The catchment basins for the large diversions at the upper end of the portals area were dry <br /> and well maintained (see Photo No. 2). The mine was not discharging water at the time of the <br /> inspection. The mine discharge location and catchment basin is shown in Photo No. 3. <br /> The sediment pond was containing muddy water at a level approximately 2 feet below the principal <br /> spillway. The silt fence near the bridge at the entrance to the mine was recently cleaned and the <br /> sediment storage/sump in front of the silt fence was excavated. However, during this inspection it was <br /> noted that some coaly material has fallen out side of the sump and silt fence(see Photo No. 4). To <br /> ensure compliance please cleanup the coaly material deposit and continue to regularly maintain all silt <br /> fences. Please ensure that all coaly material is effectively retained within the disturbed area. All other <br /> site sediment control features appeared to be in good working order. <br /> The clean water diversion ditch around the temporary waste pile is well constructed and stable. <br /> Tumbleweeds have collected in one small section of the ditch and should be removed (see Photo No. <br /> 5). The ditch should be maintained to be clear of any obstructions to ensure adequate capacity during <br /> spring runoff. <br />
