III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Drainage and diversion ditches were stable with no significant erosion or other problems noted. Only <br /> the North Collection Ditch at the South Portals area had a small amount of water flowing in it which <br /> originates from the South Portals French Drain. <br /> The transition structure in Coal Creek was inspected and is shown in attached Photo No. 4. The <br /> armored creek bottom and side slopes have functioned well and the transition zone remains stable. <br /> The location of the South Portal drainage pipe that was recently sealed and backfilled remains dry and <br /> stable. There was no drainage from the location of the sealed pipe. <br /> Support Facilities <br /> The entire South Portal reclaimed area remains stable and in good condition. The Kokopelli fruit stand <br /> is not open for business yet. The former shop and warehouse are being utilized by Kokopelli, but there <br /> is no activity at this time of the year. The South Portal area was well maintained and no problems <br /> were noted during this inspection. The reclamation throughout the South Portal area remains in very <br /> good condition(see attached photo No. 5). <br /> At the UTL loop area, Halliburton was preparing to load trucks with sand at the time of the inspection. <br /> Several rail cars loaded with"frac sand" are present at the rail loop. Tribble Mine Service was on site <br /> at the UTL preparing to load trucks with the dismantled conveyor belt structure parts. The area was <br /> muddy and site personnel were waiting for the ground to dry out a little more before they could bring <br /> trucks out for loading. The conveyor structure will be transported for use at another mine site location. <br /> No problems were noted at any of the mine site locations during this inspection. <br /> The North Decline area was inspected. At the top of the North Decline road, Mr. Rudy Fontanari's <br /> gravel pit operation is well underway. A large pit has been excavated and materials are stockpiled on <br /> both sides of the road. A trackhoe and loader were working in the pit at the time of the inspection. As <br /> seen in the attached Photo No. 6 several large piles of crushed and screened gravel are stockpiled. <br />
