III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Roadside Portals Mine conducted on March 10, 2009 by Mike <br /> Boulay of the Division of Reclamation, Mining and Safety Grand Junction Field Office. Tonya <br /> Hammond of Snowcap Coal Company(SCC)was present during the inspection. Weather conditions <br /> were cloudy and cold. Ground conditions were damp with a small amount of snow in some areas. <br /> Availability of Records <br /> The availability of records was checked on the afternoon of March 10`h. All required records were on <br /> file and available for review at J.E. Stover&Associates offices. No problems were noted with the <br /> records review. See the attached Availability of Records checklist at the end of this inspection report. <br /> Roads <br /> Roads were mostly damp in the locations west of the interstate and in the vicinity of the refuse disposal <br /> areas, North Portal, and UTL. However there was some standing water along the road accessing Coal <br /> Creek and at the South Portal along the west edge of the pavement by the guard building. Roads were <br /> muddy in some locations at the South Portal area and North Decline. The 2-West Portal locations <br /> could not be inspected due to muddy and poor road conditions. <br /> Road ditches were in good condition and road culverts were all generally well maintained throughout <br /> the various mine site locations and support facility areas. <br /> Hydrologic Balance <br /> All site Sedimentation Ponds including UTL-1 & 2, 6, 7,8,9,10,11, and 13 were inspected. Sediment <br /> Pond No.2 at the UTL and Pond 8 were the only sediment ponds retaining water. UTL#2 only had a <br /> very small amount of water in the southwest corner. Pond 8 also had only a small amount of water, <br /> well below the level of the spillway. All other ponds were either dry or only just damp due to a small <br /> amount of precipitation the night prior to the inspection. The rain gauge that SCC maintains west of <br /> the Colorado River along Coal Creek Road showed .25 inches of precipitation from the storm. The <br /> CBA#1 Sump was dry. The sedimentation ponds are all very well maintained and capable of <br /> functioning as intended. All pond embankments, inlets and discharge structures were stable and no <br /> problems were noted at any of the sediment pond locations. Pond 8 at the South portal is shown in <br /> Photo No. 1. Pond 10 located southeast of CRDA-1 is shown in attached Photo No. 2 and Pond 013 <br /> and the North Portal reclaimed area are shown in Photo No. 3. <br />
