MANAGEMENT <br />RECEIVED <br />MAR 12 2009 <br />Division of Reclamation, <br />Mining and Safety <br />Bear Coal Company intends to submit a bond release in the next couple of months. In <br />orderto expedite the review process I am submitting the following preliminary information: <br />1. Drawing showing the area nominated for release. <br />2. Reclamation bond summary for both the August 21, 2003 and February 1, 2007 <br />estimates. The bond summaries show the amount of bond that will be <br />remaining after the partial phase I bond release is approved. <br />3. Only a portion of the steep hillside reclamation is eligible for release as shown <br />on the attached drawing. Based on the aerial extent, 56% is nominated for bond <br />release so 44% is remaining. <br />4. All of the expense related to re-grading the facilities area is considered to be <br />complete. The cost to reclaim the two ponds and ditches is accounted for <br />separately from the facilities work. <br />5. In the February 1, 2007 estimate, task 08b demolish culverts, culverts 1 through <br />4 have been demolished. Also the treatment pond discharge pipes are six <br />inches in diameter. <br />6.
