.. Exhibit E - Reclamation. Plan <br />completion of operations and the eventual release of the attending financial <br />warranty and respective DMG Permit. <br />Because the state of disturbance reached its near maximum extent shortly before <br />the succession of operator's by Varra. Companies, Inc., in October 1999, the <br />progressively improving reclamation of the property is evidenced in Exhibit L - <br />Reclamation Costs, which reflects that reclamation liability has been, and will <br />continue to be, decreasing. This is further evidenced by the grading and re-soiling <br />of nearly 25.0± acres of pit wall in 2003. Concurrent reclamation will continue to <br />enhance the overall condition of the property with time. <br />A Backfill Notice follows this page, as part of this Exhibit. The use of inert fill <br />will facilitate the timely fill of Tract D, and related reclamation of affected lands <br />and use of related water resources (refer to Exhibit L - Reclamation Costs. <br />Varra Companies, Inc.
