Exhibit E - Reclamation. Plan <br />The final land configuration results in two ponds of 128.4± and 7.0± acres. The <br />balance of affected lands above the anticipated final water level will be stabilized <br />utilizing the previously approved seed mixture, as iterated under Exhibit L - <br />Addendum C: Re-vegetation Seed Mixture Costs. <br />An optional seed mixture is provided under Exhibit L - Addendum C(2): Re- <br />vegetation Seed Mixture. This mixture, originally approved by the Division in <br />permit M99-006, will be applied at the option of the Operator over failed seeding <br />areas from the use of the original seed mixture approved by the Division. While <br />the original seed mixture may be applied to failed areas as well, and is accounted <br />for in this manner under Exhibit L - Reclamation Costs, the Optional mixture <br />provides for the use of other genetic potential and combinations under failed <br />conditions. Since the Optional mixture is more expensive than the original <br />approved mixture, the use of the Optional mixture as a first seeding should not be <br />discouraged. <br />All affected lands remaining above the anticipated final water level of the ponds, <br />and not otherwise occupied by existing or planned mixed uses, will be re-vegetated <br />with the approved seed mixture(s) for general agriculture. Mixed use(s), other than <br />general agriculture, may include, but is not limited to, the retention of existing <br />structures as desired (e.g., concrete batch plant, shop, scale-house/office, and <br />supporting facilities (fuel depots, parking areas, oil and gas facilities access, etc.) <br />for continued industrial - commercial use (as supported by existing approved Weld <br />County Building Permits); the creation of unforeseen future structures, and for the <br />use and development of on-site water resources. Since the area of surrounding <br />lands is a mix of these uses as well as light residential, the site end use will retain <br />these potentials (refer to Exhibit F - Reclamation Plan Map). <br />The rate of reclamation will follow concurrently with extraction and the respective <br />timetables identified for extraction under Exhibit D - Mining Plan. All timetables <br />are contingent upon market conditions, therefore, a probable range of time is <br />indicated. With extraction activities anticipated to take up to 30 years to complete, <br />reclamation will add an additional five years minimum to this estimate, bringing <br />the anticipated life of the mine anticipated to 35± years. <br />Overall, the Amendment clarifies and details the nature and progression of <br />reclamation over the affected lands in a manner absolutely lacking in the original <br />application. In this manner, the capacity of the operator to meet the objectives of <br />the Amended plans is greatly enhanced, and will be a great asset to the successful <br />Varra Companies, Inc.
