Exhibit G - Water Information <br />Since October 1984, the permitted lands have been dewatered and mined dry. An <br />approved storm water discharge permit was originally obtained by the former <br />operator, and transferred to Varra Companies, Inc., during the time of succession <br />of operator to Varra Companies, Inc., in October 1999. <br />In July 2003, Varra Companies, Inc., obtained a Substitute Supply Plan (SSP) to <br />cover both existing and planned exposed ground water. A copy of the approved <br />SSP is included at the back of this Exhibit. Additional information on how the <br />SSP will apply as extraction and reclamation activities progress over the permit <br />area is detailed under Exhibit L - Reclamation Costs/ Water. <br />Existing wells, on and within 600 feet of the property, are indicated on Exhibit C - <br />Pre-Mining and Mining Plan Map. There is no known or identified injury to these <br />wells in the nearly 20± years of operations. <br /> <br />The Flood Way and Flood Plain of the Cache la Poudre River is under revision by <br />the U.S. Army Corps of Engineers, and in Cooperation with the City of Greeley, <br />Weld County Colorado, and FEMA; Varra Companies, Inc., will attend to this <br />matter to the extent warranted under that process, and as the information pertaining <br />to the Flood Plain and Flood Way study develops. Resolution of this matter will <br />likely require time well beyond the more immediate considerations of this <br />Amendment. <br />It is at this point, reasonably beyond the scope and purposes of this Amendment to <br />attend to this complex and unique technical matter. If changes to the permit area <br />are proven over time to be technically justified by the FEMA study; as supported <br />by independent and complementary review and analysis by Varra Companies, Inc., <br />and or its agents, engineers, etc.; and otherwise in cooperation with FEMA and <br />U.S. Army Corps of Engineers authorities and processes; Varra. Companies, Inc. <br />will work cooperatively with the Division of Minerals and Geology, and if <br />necessary, submit a Technical Revision to this Amendment to the Division of <br />Minerals and Geology to reflect the required changes, to the extent, if any, they <br />become necessary. Therefore, the operator, Varra Companies, Inc., <br />specifically petitions the Division to agree as part of the approval of this <br />Amendment, that any subsequent and necessary revisions to Permit M78-056, <br />pertaining to the Flood Way or Flood Plain, be allowed as a separate <br />Technical Revision to the permit, should the Division deem that revisions to <br />the permit respective of this concern are warranted by the technical merits. <br />Varna Companies, Inc.
