Exhibit D- Mining Plan <br />A concrete batch plant and wet processing plant was established by the previous <br />operator and is retained in this Amendment, and are clearly visible in Exhibit C: <br />Pre-Mining and Mining Plan Map, along with a shop, yard and supporting fuel <br />depots, and related support areas, including a scale-house/office. Approved and <br />final Building Permits have been obtained for these structures, and will be <br />maintained as part of the end use of the property, unless otherwise removed by the <br />Operator. Additionally, provisions for an asphalt batch plant and periodic use of a <br />portable dry plant are also a necessary inclusion to operations under this permit. <br />Thy dry plant is periodically set up near existing stockpiles within Tracts A and C, <br />while an asphalt batch plant is merely proposed as a potential use. <br />Known structures and landowners, including above and below ground utility <br />owners, located on and within 200± ft. of the permit boundary are shown on <br />Exhibit C - Pre-Mining and Mining Plan Map. Exhibit S - provides certification <br />from a registered professional engineer that these structures will not be harmed by <br />continued operations; nor has any evidence of harm surfaced over the nearly 20± <br />years of operations. <br />Extraction activities will continue to remove aggregate to a mean depth of 25.0± <br />feet, with a potential total depth to 40± feet from toe of slope (pond bottom greater <br />than 3H:1 V from the toe of the 2H:1 V pond wall) as indicated in Exhibit F - <br />Reclamation Plan Map. Anomalous depths greater than 40± feet may occur, and if <br />removed beyond 40± feet in depth, may be extracted either dry, or wet. If <br />extracted wet, a dredge may be utilized for the removal. Regardless, all final basin <br />(pond) slopes will conform to Rule 3.1.5(7). <br />The general direction of extraction activities over the diverse Tracts is shown on <br />Exhibit C - Pre-Mining and Mining Plan Map. Extraction will occur to within <br />distances stated under Exhibit S - Permanent Man Made Structures - Protection of <br />Existing Facilities Map. Extraction will occur to within 25± feet of well heads and <br />facilities, and be backfilled to create a 100 foot radius around the well head for <br />future well activities. The fill will occur concurrently with extraction around the <br />well head and facilities, to the extent practical. At all times, safety will take <br />precedent and over-riding Amendment to any element of the permit Amendment. <br />The timetable for extraction activities and concurrent reclamation (refer to Exhibit <br />E - Reclamation Plan) is as follows, commencing May 2003.
