Exhibit D- Mining Plan <br />Status of Affected and Unaffected land as of this Amendment (Refer to Exhibit C - <br />Pre-Mining and Mining Plan Map: <br />The 229.89 Acres of lands comprising the permit boundary are as follows: <br />44.66± Unaffected (the balance of 185.23 acres are affected as described) <br />22.14± Affected Lands not otherwise described. <br />13.46± Acres of fill - Tract D <br />26.26± Acres Pond - Tract C <br />42.10± Acres Basin - Completed portion of Tract A <br />17.82± Acres of Active Extraction - Tract A <br />20:15± Acres of Planned Extraction - Tract A <br />25.60± Acres of Planned Extraction - Tract C <br />11.61± Acres of Planned Extraction - Tract B <br />6.09± Acres of permanent roads <br />Exhibit C - Pre-Mining and Mining Plan Map, shows the location, extent and <br />features described above. The map also shows all man made structures located <br />within 200 feet of the excavation; including creeks, roads, buildings, oil and gas <br />wells and lines, and power and communication lines on and within 200 feet of the <br />affected land; as well as all adjoining surface owners of record. A listing of the <br />adjoining surface owners names and addresses are listed under Exhibit C - Text, <br />correlated with those shown in the aforementioned map. <br />This operation is active since October 1984, under a permit approved by the <br />Division in March 1978. Varra Companies, Inc., assumed the Operations under <br />the permit by Succession of Operator in October 1999. Shortly before the <br />Succession, affected lands over the permit area reached near maximum <br />disturbance. Subsequent operations and reclamation by Varra Companies, Inc; <br />including the act of extraction itself, is steadily improving the condition of the <br />affected lands while incrementally decreasing the reclamation liability of the <br />operations, as evidenced in Exhibit L - Reclamation Costs. <br />Geology and subsurface conditions are described in the original permit approval, <br />extracts of which are included as part of, and at the back of, this exhibit. Method <br />of mining is presently dry, with discharge of waters conducted under an approved <br />Colorado Dept. of Health discharge permit (COG500100). Extraction utilizes, but <br />is not limited to, diverse heavy equipment; including, backhoes, scrapers, <br />excavators, dozers and related heavy equipment. A grader and water truck <br />maintain access throughout operations. Access is clearly indicated under Exhibit C <br />- Pre-Mining and Mining Plan Map. <br />Varra Companies, Inc.
